A company was fined by the federal government for running a discriminatory employment advertisement that only allowed submissions from people of color.
As a result of the company’s activities, separate agreements were reached with the Department of Labor and the U.S. Department of Justice.
Company Fined For Publishing Prejudiced Job Advertisements
The prejudiced ad was released in March 2023 by Virginia-based IT services company Arthur Grand Technologies. Eligible candidates were limited by the advertisement to “only US Born Citizens [White] who are local within 60 miles from Dallas, TX.”
In April 2023, the Office of Federal Contract Compliance Programs (OFCCP) carried out an inquiry.
According to the study, there were discriminatory limits on the business analyst post that Arthur Grand Technologies advertised.
The job listing was published on an open employment website. The purpose of the job was to support HTC Global and Berkshire Hathaway, two clients.
Another instance of discriminatory tactics by Arthur Grand Technologies was identified by the Department of Justice. The company was the subject of an inquiry launched in May 2023 by the Immigrant and Employee Rights Section (IER) of the Civil Rights Division.
Arthur Grand was judged to have discriminated against people on the basis of their national origin and citizenship status.
Civil Penalty For Arthur Grand Technologies
On Indeed, a recruiter for Arthur Grand’s Indian subsidiary submitted the discriminatory posting, which garnered significant attention and was extensively shared on social media.
Due to Arthur Grand’s illegal acts, those who are authorized to work in the United States were discouraged from applying for the position. A civil penalty was mandated for Arthur Grand Technologies as part of the Justice Department settlement.
The business must update its employment practices and provide training to its staff on the obligations of the Immigration and Nationality Act (INA). From now on, Arthur Grand Technologies will be under departmental observation.
Individuals who submitted complaints will receive compensation from the corporation, according to a conciliation agreement with the Labor Department. Arthur Grand pledged to give all staff members involved in candidate recruitment and selection training tailored to their individual workplace.
